Warren-Boswell Families

 

Agnes Warren, born ca 1819 in Lincoln County, Kentucky, married Robert Hiram Daugherty there on 3 July 1849. She was his 3rd or 4th wife. They immigrated to Burnet County, Texas, by 1855 and their children are listed in the DAUGHERTY FAMILY chapter. Agnes died in Burnet, Texas, on 17 January 1907 (see her death notice in DAUGHERTY Photos) and was buried beside her husband and an infant in the south section of the oldest part of Old Burnet Cemetery, inside a waist-high rock wall.

Agnes's grandmother was Judith Swann Boswell, whose father was George Ellitt Boswell, born 1745 and died 11 Apr 1817 in KY. He was married twice and had 25 children. From 1769-71 he lived near Warrenton, Fauquier Co., VA. He lived from 1773-1787 near Harrisonburg, Augusta (now Rockingham) Co., VA. He provided civil service for Virginia in the Revolutionary War. In 1787 he sold his land in Fauquier Co., VA and immigrated to Harrison Co., KY, near Lexington, and laid out the town of Boswell's Cross Roads (now Leesburg), in Harrison Co. and built a log house near springs on Silas Creek, near the lines of Harrison, Bourbon, and Scott Cos. In the War of 1812, he served as a General.

In 1766, George Ellitt Boswell married Judith Swann Fauntleroy in Northumberland Co., VA.

    Witnesseth, That whereas BUSHROD WARREN one of the parties of the first part, filed his Petition in the Circuit Court among other things praying for the sale of a tract of land hereinafter described, making the afsd parties of the first part Defendants thereto and whereas upon the Hearing of said Petition a Decree was rendered ordering and directing a sale of Said tract of land at the September Term of said County in the year 1835, and when at the 13th of November and when on the 13th day of November thereafter the said JAMES P. MITCHELL who was appointed a Commissioner for that purpose, exposed said tract of land at sale to the highest bidder in pursuance of said Decree amd thereupon the said MICHAEL G. YANCE became the purchaser at the price of $4,567.75 . . . has made full payment of the purchase money and at the September term of said Court in the year 1838 another Decree was . . . sell unto the said MICHAEL G. YANCE and his Heirs forever the afsd. tract or parcel of land situate lying and being in Lincoln County on the waters of Clarks Run and bounded as follows. Beginning at a stone corner to SAMUEL W.      Lincoln Co. KY Deeds, Book Q, pp. 126-127

    John Warren, Sr., was the son of Capt. William Warren, Revolutionary soldier born 1740 in Virginia, served and provided patriotic service in Spotsylvania County, Virginia, where he married Anne Wilcox. They came to Lincoln County, Kentucky, in 1779 and settled on the Dix River, living in the stockade at "Warren's Fort" south of Danville, only two years after the first settlement in the county, Logan's Fort, completed and occupied by February 1777 at Stanford using a log cabin Logan began on a visit in 1775 and finished 1776 as one corner of the stockade.

    Another Warren in early Lincoln Co. was JAMES Warren, perhaps a brother of William, and a Revolutionary soldier from Virginia, probably in Halifax Co. He married an unknown wife probably by 1772 in VA, and signed consent in Lincoln Co., KY, for Hannah Warren to marry Aquilla Wiley on 25 Jan 1790; and for Elizabeth Warren marry Benjamin Wiley on 20 Aug 1792.

    James Warren married his 2nd wife Catherine Felan on 1 Mar 1790 in Lincoln Co., and their names are in the DAR Patriot Index, where his birthdate is given as 1742 and his death date Jan 1829 in KY.

    There's no way to know whether the James Warren who married Margaret Dunbar, 24 Feb 1795, in Lincoln Co. was the son of William Warren or of James Warren. When Samuel W. Warren (son of William) wrote his will, appearing to be a single man since he mentioned no wife or children, he left a legacy to Phoebe Warren, the wife of his brother James, but perhaps his brother James married 1st Margaret and 2nd Phoebe?

    Anne Wilcox Warren predeceased her husband William Warren, for she was not mentioned in his will written 17 May 1817. William died 3 September 1819.

     In the name of God Amen, I, WILLIAM WARREN of Lincoln County and State of Kentucky, being in a perfect state of mind and memory, but knowing the uncertainty of life, do make constitute and ordain this as my last Will and Testament.

    First, I give and bequeath to my son JOHN WARREN sixty-six acres of land adjoining him on the North, which I purchased from ABRAHAM BOWMAN, which land if not worth one thousand Dollars at my death, or at the time he gets possession of it, an addition in money shall be made in order to make the thousand Dollars including said land and money ~

    I give and bequeath to the lawfully begotten children of my son WILLIAM WARREN jointly one thousand Dollars in Bank stock, to be furnished by my son SAMUEL WARREN in six years after my death, and to be paid by said SAMUEL WARREN out of the money arising from the two hundred acres of land which he is to receive and account for at forty shillings per acre, as herein after named: the profits of which Thousand Dollars my son WILLIAM is to receive and enjoy during his natural life, and after his death to be equally divided amongst his aforesaid children share and share alike ~

    I give and bequeath to my sons JAMES & THOMAS B. WARREN four hundred and fifty acres of land a Military claim, lying in Christian County, on Little River for their joint use & benefit ~

    I give and bequeath to my son SAMUEL W. WARREN two hundred acres of land including the plantation and improvements whereon I now live; also two hundred acres adjoining the same by him paying at the rate of forty shillings per acre for the same, two years after my death. I also give and bequeath to him a negro Boy named JOE and a negro girl named CHARLOTTE ~

    I give and bequeath to my daughter FRANCES BURCH, the plantation whereon she formerly lived containing one hundred acres (being the same whereon FOUCHE T. TAYLOR now lives) with its there appurtenances ~

    I give and bequeath to my daughter POLLY TAYLOR all my land lying between that conveyed to my son WILLIAM and that bequeathed to my daughter FRANCES, also one negroe woman named SALLY. All the foregoing bequests to be furnished from my property now in my possession, and not otherwise disposed of and in order to quiet disputes that may arise disputing property already received from me by my several children I hereby confirm every donation of every kind which may have came into their possession and not named in the foregoing bequests, except one horse received by JACOB STEPHENS worth $75.00 and two horses received by LETTICE S. EWING worth fifty Dollars each, which they are to account for the value of which horses together with the residue of my Estate, whether real or personal, that may be in my possession at my decease -- I give and dispose of in the following manner (Viz).

    To LETTICE EWING, JOHN WARREN, the children of ANN STEPHENS, WILLIAM WARREN, ELIZABETH KENNEDY, JAMES WARREN, THOMAS B. WARREN, SAMUEL W. WARREN, and POLLY TAYLOR to be divided amongst them in nine equal parts, after deducting from the same two hundred Dollars each, for FRANCES BURCH & WINNIFRED EWING if they think proper to accept of it in addition to what they have already received from me, which I bequeath unto them instead of an equal division with my other children, as they the said FRANCES & WINNIFRED have no issue ~

    I nominate and appoint my sons, JOHN WARREN, WILLIAM WARREN, JAMES WARREN, THOMAS B. WARREN & SAMUEL W. WARREN as my Executors, who are authorized to pursue such ways & means in the disposition of this my last Will and Testament as will best suit the distribution of my Estate, and their convenience, and not incompatible with the provisions herein contained -- In testimony whereof I have hereunto set my hand & affixed my seal this 17th day of May 1817.

    At a County Court holden for the Co. of Lincoln at the Court house in the Town of Stanford on Monday the 11th day of October 1819. The last Will and Testament of WILLIAM WARREN deceased was exhibited into court and proven by the oaths of EVAN SHELBY & ISAAC SHELBY Jr. two of the subscribing witnesses and ordered to be recorded. And on the motion of JOHN WARREN & SAMUEL WARREN two of the Executors named in the said Will, who made oath as the law directs, and executed bond in the penalty of twenty four thousand Dollars, with EVAN SHELBY & ISAAC SHELBY their securities. Ordered that a certificate of the probate of the said Will be granted them in due form of law. And it is ordered that WILLIAM WARREN, JAMES WARREN, & THOMAS B. WARREN, the other three Executors named in the said Will have leave to qualify at a future period, should they deem proper.

    In the 1820 census of Lincoln County, Samuel W. Warren and his brother William Warren were enumerated next to each other, both age 45+, so let's assume their father was at least 65 at his death, therefore born by 1755:

    Numerous Loose papers in the William Warren Estate (Box 17) include various receipts signed by:

    • 19 April 1826, for George B. Warren, administrator of the estate of William's son John Warren (Sr.), to Eliza Beadles, "Sir you will greatly oblige me in sending the balance due me for Bushrod and Elizabeth's tuition; each of them came 6 months, which is 10$. I received 3$25C of it. The balance 6$75C this will answer for a receipt, if you think proper to send the money; yours with respect."

    • 25 September 1830, John F. Warren, "Received of Saml. W. Warren administrator to the estate of William Warren Decd. $82.00 in part of my Dividend as one of the legatees of my Father."

    • 2 October 1835, Margaret Warren, the widow, "Received of Saml. W. Warren administrator of the estate of William Warren deceased; from the year 1827 to 1835 ~ $265.25 for the boarding clothing and tuition of my daughter Ann Warren." Teste: William Warren.

    • 2 April 1836, John F. Warren, "Received of Saml. W. Warren administrator to the estate of my Father, William Warren deceased, $100.00 supposed to be the balance due me as one of the Legatees."

    • 3 July 1837, Margaret Warren, "Received of Saml. W. Warren admr. of William Warren decd. $40.00 for books and schooling of my daughter Ann Wilcox Warren."

    John Warren, son of William Warren, died intestate in 1824 and his son George B. Warren was appointed administrator. Numerous loose papers in John's Estate record (Box 17) include various receipts paid by George B.:

    • 6 March 1827, to John Rousey, "to the making of Shoes for decedant family to the amount of $4.00.

    • 14 December 1827, to Munford I. Bale, To leather bought by G. B. Warren for the use of decedent's family, $7.00.

    • 6 December 1836, "I hereby certify that I. S. Warren personally appeared before me a Justice of the Peace in and for said County and made oath that the above amt is just to the best of his knowledge and was paid by G. B. Warren admr. of John Warren, decd. Given under my hand this 6th day of December 1836. F. T. Taylor, J.P., L. C.

    • 6 December 1836, "This day appeared before the undersigned, a Justice of the Peace in and for sd. County, Judith I. Warren & made oath she knows G. B. Warren one of the admr. of John Warren decd, paid the sum of $7 for leather to make shoes for decedents negroes after his death, said leather being bought of M. I. Bale. Given under my hand this 6th day of December 1836. F. T. Taylor J.P.

    • No doubt because of minor children Bushrod and Elizabeth, the administration was ordered on this date to be continued over until the Fall term of 1837.

    • The administrator George B. Warren was responsible for an estate worth $2,505, and on the Sale his mother Judith Warren was a frequent buyer.

    James R. Warren purchased land from John Huston and wife Milly on 24 April 1840, though I don't know whether he was James the son of James Warren, or James the son of William Warren, whose brother Isaac sold land around the same time:

     This Indenture of bargain & sale made & entered into this 24th day of April 1840 between JOHN HUSTON & MILLY HUSTON his wife of the first part & JAMES R. WARREN of the second part, all of Lincoln County Kentucky. Witnesseth ~ that the said JOHN HUSTON & MILLY his wife for & in consideration of the sum of Two Thousand Four Hundred & thirty-seven Dollars fifty cents ($2437.50) to them in hand paid, the receipt of which is hereby acknowledged, have by these presents do grant bargain sell and convey unto the said JAMES R. WARREN & unto his heirs & assigns forever One Tract of land lying in Lincoln County on Harris Creek bounded as follows . . . 162½ acres . . .

    Thanks to the will of William's son, Samuel W. Warren, recorded in 1840, we have a status report on some of William's heirs and heirs of his children:

     I Samuel W. WARREN of the Co. of Lincoln, State of Kentucky do make and ordain this my last Will and Testament.

    First . . . as soon as convenient after my decease my Executors proceed to make sale of all my estate real personal and mixed. My slaves to be sold at private sale to persons residing in Lincoln Co. . . none to be sold to parties residing out of the state unless the slaves themselves elect to be sold to a purchaser residing elsewhere. The residue of my personal estate to be sold at public sale to the highest bidder at a credit of one year's interest from date of sale. . .
    if any one of my nephews being a son of my sisters and brothers should buy the tract of land on which he now resides, that said purchaser be allowed the sum of ten thousand dollars, and if he . . .

    Secondly. My will and desire is that all my just debts and funeral expenses be paid out of the first money of my estate that comes to the hands of my Executors.

    Thirdly. I will and bequeath to JUDAH WARREN widow of my brother JOHN WARREN the sum of one hundred dollars.

    Fourth. I will and bequeath to PHEBE WARREN widow of my brother JAMES WARREN the sum of one hundred dollars.

    Fifth. I will and bequeath to MARGARET WARREN widow of my brother WILLIAM WARREN the sum of one hundred dollars.

    Sixth. I will and bequeath to my sister ELIZABETH KENNEDY the sum of one hundred dollars a bed and her [ ]

    Seventh. I suspect that after my decease my sister LATITIA EWING will live with her daughter LATITIA SPEARS, and as it is my wish that she should, I will and bequeath to JACOB SPEARS the sum of five hundred dollars to aid and assist him in providing for the comfort and convenience of my said sister LATITIA EWING, and furthermore I will and desire that my Executors retain in their hands the sum of two thousand dollars as long as my sister LATITIA EWING shall live, the interest of which sum I wish to be paid to her guardian yearly commencing at the day of my decease for her support.

    Eighth. My will and desire is that my two Executors hereafter named shall have and retain in their hands the sum of one thousand five hundred dollars to be equally divided between them as a compensation for their services . . . if either should fail or refuse . . . the one that does serve shall have and retain the whole of the aforesaid sum.

    Ninth. My will and desire is that the residue of the proceeds of the sale of all my estate real personal and mixed be divided into forty equal shares and to be distributed in the following manner:
    To my sister POLLY TAYLOR eight shares and in case of her death to be equally divided among her children.
    To the children of my deceased brother THOMAS WARREN eight shares to be equally divided among all the children.
    To LATITIA E. ROCHESTER, FANNY TAYLOR, GEORGE B. WARREN, SUSAN ALLEN, ELIZABETH WARREN, and BARBARA WARREN - children of my brother JOHN WARREN I give one share each, making six shares.
    To JEREMIAH WARREN, WILLIAM W. WARREN, GEORGE BE WARREN, ELIZABETH D. LEE, JAMES WARREN and SAMUEL W. WARREN children of my brother JAMES WARREN I give and bequeath each one share, making six shares.
    To ROBERT EWING, ELIZA K. BRISCOE, JOHN L. EWING, LETITIA SPEARS and BAKER T. EWING children of my sister LATITIA EWING, I give and bequeath each one share making five shares.
    To JOHN F. WARREN, SAMUEL WARREN, WILLIAM WARREN, JAMES WARREN, ISAAC C. WARREN, ACENAT FURR, and ANN WARREN children of my brother WILLIAM WARREN I give and bequeath each one share making seven shares.

    Tenth. . . After the death of my sister LATITIA EWING the two thousand dollars which is herein set apart for her shall in like manner be divided into forty equal shares and distributed in the same manner and to the same persons . . .

    Eleventh. I hereby nominate and appoint Evan SHELBY and Isaac SHELBY jointly trustees for the purpose of receiving from my Executors the legacies herein bequeathed to FANNY TAYLOR and ELIZABETH WARREN two of the children of JOHN WARREN dec'd and the said trustees are hereby directed to apply the interest of the said legacies annually . . .

    Twelvth. I hereby nominate SAMUEL WARREN son of my brother WILLIAM and SAMUEL M. WARREN son of my brother JAMES Executors . . .

    Thirteenth. I was one of the Executors of the last will & testament of my Father WILLIAM WARREN deceased and I feel confident that I paid to each one of his divisees more than they were entitled to under said will . . . but as my papers are now somewhat disarranged it may appear after my death . . . that some of them did not receive their full Share, and dissatisfction may arise among some of the divisees of this my last will and testament and who were also divisees to the will of my father, or whose parent was a divisee, and should that be the case as I wish to give my Executors as little trouble as possible -- I now declare that should any divisee of this my last will and testament was hereafter set up any claim to my Father's estate or any part thereof against my Executors, either through . . .

    Note Samuel W's reference to his brother William Warren's widow Margaret. William was deceased by 30 May 1835, when several joint property owners appearing to be his heirs, divided property belonging to William, his widow Margaret, or Samuel W. Warren, deeding 243 acres on Clarks Run to their uncle F. T. Taylor (Fouche T. Taylor, Polly Warren's husband). So, apparently, the land inheritance from William Sr. had not all been legally recorded?

    A series of Warren family documents recorded in Lincoln County on 6 July 1840, apparently after the death of Samuel W. Warren, is lengthy but each document further reveals relationships. On 25 September 1839, the following deed required testimony of processioners as to an original corner of Samuel W. Warren's land, which may have come from his father's survey?

     We two of the processioners in and for the County of Lincoln being called on by the Executors of SAMUEL WARREN decd to procession said decedent's Lands go on said decedent's Land on the 25th of September 1839 and in conjunction with the coming survey or procede to line toward remark & place corner stones as the law directs, by beginning at A in the annexed plat, a rock corner to JOHN DODD, in McOWEN's line, at the letter A there was a white oak called for but missing, this rock was placed by the corresponding evidence of PETER DEPAW, SAMUEL MOON & JOHN YOUNG, whose depositions are herewith filed. We then run with DODD's line S. 74 5/4 W. 190 poles to a rock at B, a stake called for . . . to C . . . turning with SAMUEL WARREN's line . . . to a rock at D and hickory marked . . . to E . . . to a rock at F . . . a rock at G on the side of the Danville Road in F. TAYLOR's line . . . to a rock at H thence with the corner of TAYLOR's line . . . to a rock in the center of the road in McFERRIN's line at I to a rock at K corner to McFERRIN thence . . . to A containing 495 Acres and 3 Roads.

    The earliest in the series of deeds was dated 30 May 1835:

    This Indenture made the 30th of May 1835 between JOHN F. WARREN and MARY his wife of the Co. of Mercer and State of Kentucky and SAMUEL W. WARREN and WILLIAM W. WARREN amd JAMES WARREN of the Co. of Lincoln and State afsd. and WOODFORD F. FURR and HARRIETT his wife, late HARRIETT WARREN, of the Co. of Woodford of State afsd, of the one part, and F. T. TAYLOR of the Co. of Lincoln and State afsd of the other part. Witnesseth that for and in consideration of the Sum of $250.00 paid to the said JOHN F. WARREN and the like sum paid to SAMUEL W. WARREN and the like sum paid to WILLIAM W. WARREN and the like sum paid to said JAMES WARREN and the like sum paid to said WOODFORD F. FURR, the receipt of which sums we hereby acknowledge, the parties of the first art doth by these presents grant bargain and sell . . . unto the said F. T. TAYLOR and his heirs forever all their interests to wit, each a seventh, that is the said in all five sevenths in and to the following tract or parcel of land, situate and being in the County of Lincoln on the waters of Clarks Run, the entire tract being 243 acres bounded as follows. WARREN this day personally appeared before us who being examined privily and apart from her husband as the law directs voluntarily with her own free will and consent relinquished her right of dower to the within named premises conveyed by this deed.     Whereas F. T. TAYLOR did some years ago purchase from the widow and heirs of WILLIAM WARREN deceased a certain tract of land in the County of Lincoln on the waters of Clarks Run containing about 240 acres in which MARGARET WARREN the widow of said decedent being entitled to dower, and [ ] lands the said widow, some years ago did receive from said TAYLOR a valuable consideration forher said interest in said land, yet she never relinquished her said claim. Now this indenture witnesseth that for and in consideration of the presises afsd and of one dollar in hand paid, the receipt of which is hereby acknowledged, the said MARGARET WARREN now of Lexington, Kentucky hath bargained Sold and released unto the said F. T. TAYLOR of the said County of Lincoln and State of Kentucky, her entire interest in said tract of about 240 acres of land, sold and conveyed as afsd, to him and his heirs and assigns forever, whether the same be in dower or otherwise, and the said MARGARET herself and her heirs, her said interest in said land to the said TAYLOR his heirs &tc . . .     This Indenture made this 23rd day of April 1840 between ISAAC S. WARREN of the County of Lincoln and State of Kentucky of the one part and FOUCHE T. TAYLOR of the County and State afsd. of the other part, Witnesseth that said ISAAC S. WARREN for and in consideration of $500.00 in hand paid, the receipt whereof is hereby acknowledged, hath granted bargained and Sold and by these presents doth grant bargain and sell unto the said FOUCHE T. TAYLOR Senr. his heirs and assigns all my interest which I derived by inheritance from my father WILLIAM WARREN, it being the one-seventh of all that tract or parcel of land situate and being in the County of Lincoln on the Waters of Clarks Run and bounded as follows, to wit ~ Beginning at a stone placed in the late WILLIAM REED's boundary line, thence South . . . to two sugartrees . . . to black gum in the late GEORGE GABBARD's corner . . . another of GABBARD's corners . . . to a stone on the east side of the LS line . . . thence with REED's old line . . . to the Beginning, containing 243 acres . . . To have and hold the land hereby conveyed with the appurtenances unto the Said FOUCHE T. TAYLOR Senr. the one-seventh of the afsd. land . . .

    William Warren is one of only two Warrens listed in the DAR Patriot Index as dying in Kentucky. The other is James Warren, born ca 1742, birthplace not stated, died Jan 1829 in Kentucky, a soldier and patriotic service in Virginia, who married 1st Mary _____, and 2nd Catherine Felan in Lincoln Co., KY 1790. Two Warren females married 1784 and 1792 in Lincoln Co., "daughters of James Warren," but whether James was a brother of William or a son of William has yet to be determined through further research. Copies of DAR lineage applications on both have been ordered, and will hopefully help identify some of the deed grantors and grantees listed above.

    The 1790 and 1800 Kentucky census (lost and reconstructed from taxlists) showed no Warrens in Lincoln County.

    Green B. Warren married Rebecca Daugherty in Lincoln Co., 5 July 1838, and subsequently settled in Russell Co., KY. Their parents or relationship to our family have not been identified by descendant Carol Marcum. Green Warren is said to be from Mercer Co., KY, and note that John Warren mentioned in an estate above lived in Mercer Co.

    We hope to find mutual ancestry -- the relationship of Agnes to Green Warren and of Rebecca to Hiram Daugherty. Rebecca's mother Mary Daugherty signed permission for the marriage.

    The earliest Virginia Patent to a Warren was in 10 Aug 1642, to WILLIAM WARREN, "650 acres on the north side of Charles River: Beg.g at the first pynie point being a peninsula and from thence upp parrallell to the river," (Land Office Patents No. 1, 1623-1643 (v.1 & 2), p. 796). However, no link to him from Agnes's great-grandfather Hugh Warren (1700-1747). He left orphan children maybe raised by the Wilcox family.
